Purchasing and refunds from the Foyles website

Foyles unconditionally guarantees books purchased through this site, except those sold via the Foyles Marketplace where different terms and conditions apply. If you are not completely satisfied with your purchase, you may return it to us in its original condition within 30 days of receiving your delivery or collection notification email for a complete refund. This will include the cost of postage to you but the buyer is responsible for the return cost. However if the return is due to an error that we or our service providers have made, we will gladly refund both the original delivery charge and the cost of return postage.

If the item is damaged upon receipt or collection please advise us within 7 days. The time limit for return is still 30 days for your convenience. Again the cost of returning such an item will also be refunded.

eBooks are however not refundable unless the product is faulty as these are not returnable by either the purchaser or the retailer to the supplier. eBooks are deemed delivered to the purchaser upon the provision of the download file and Foyles is not responsible for any issues local to the purchaser, or for any decision by the purchaser not to download the eBook.

Returns Procedure

All returns should be securely wrapped and sent, with the original packing slip and reason for the return, to the following addresses: Returns Department, W & G Foyle Ltd, 113-119 Charing Cross Road, London WC2H 0EB, United Kingdom.

Delivery Times

In the event of dispatched items being delayed or lost in the post we will offer to replace or refund:
21 days after dispatch if the item was sent 2nd class, UK Royal Mail
14 days after dispatch if the item was sent 1st class, UK Royal Mail
21 days after dispatch if the item was sent Airmail, EU and Europe
21 days after dispatch if the item was sent Airmail, North America
35 days after dispatch if the item was sent Airmail, Rest of the World

Order Progress

You can check your order's current status in your account. If your books have not arrived within the quoted delivery time you can inquire into the status of your order by e-mail to orders@foyles.co.uk, by fax to (+44) (0)207 434 1574 or by telephone to (+44) (0)207 440 3225.

Order Cancellation

A customer may cancel an order between placing the order and up to 7 days after receipt of the goods. If the cancellation happens after the goods have been despatched then a refund will be made upon receipt of the goods back at Foyles. The cost of returning the goods to Foyles will be the responsibility of the customer or Foyles depending on the reason for cancellation. Please see our Refunds & returns Help section for more details.

Please note that both Marketplace items & eBooks are despatched as soon as the order is placed, so cancellation before delivery is not possible. See Marketplace help or eBooks help as further restrictions on refunds apply to these items.

Responsibility for Local Taxes and Duties

The UK sales tax of Value Added Tax (VAT) is not payable on books, but is applied at 20% to DVDs, videos, software and other non-book material. In the UK VAT applies to eBooks. Our eBooks are sold at 19% VAT which is the German rate due this being the base of txtr, our eBooks partner.

VAT is only charged on deliveries within the European Union. If you are within the EU and have a VAT code that means you are VAT exempt, please include this in your Gift Message and our staff will amend your order accordingly. There is no tax chargeable to customers outside the European Union.

Where goods are imported from abroad on the customer's behalf and sent directly to the delivery address the cost of tax is also included in the purchase price. However in some circumstances customs may require payment of the tax by the receiving party before the delivery can be completed. In this case the buyer should pay the customs agent, keep proof of payment and contact Foyles Web Team who will refund any tax paid.

When we ship books for delivery outside the United Kingdom, the recipient is liable for any local taxes or import duties that may be payable. Foyles can take no responsibility for this and if the goods are returned due to unpaid tax the costs will not be refunded as the sale has been completed. Although the goods can be re-despatched with only a further charge for dispatch at the customer's request.

Security of Credit Card Payment Options

This site uses encryption and secure (SSL) servers to help ensure the privacy of any information that you provide. However, the security of information and payments transmitted via the Internet cannot be guaranteed. Any losses incurred or sustained by users who transmit information by means of e-mail or other internet link shall be borne solely and exclusively by such user and in no event shall any such losses in whole or part by borne by Foyles.

Data Protection

Foyles undertake not to divulge to any third party any information concerning customers that would be in breach of the Data Protection Acts.

Gift Cards Terms and Conditions

Foyles Gift Cards can be used as full or part payment for merchandise sold in Foyles stores or the Foyles website www.foyles.co.uk. The exception are eBooks via our eBooks site at ebooks.foyles.co.uk.

No change or refunds in cash will be given where the sales transaction is for an amount less than the balance on the card, but the balance may be retained on the card and applied to future purchases.

The card may be used for payment of goods of a higher price than the balance on the card on payment of the difference. Where goods are subsequently exchanged for items of lesser value, the difference will be added to the balance of the card. A card cannot be used to purchase eBooks, Theatre Tokens, additional gift cards or National Book Tokens.

The minimum amount required to activate or top-up a card is £1.

If the card is not used for a period of 24 consecutive months the card will automatically expire and any remaining balance will be deducted. To check your balance either ask in-store or call us on 020 7437 5660 and select menu option 4.

Foyles cannot be held liable for lost, stolen or damaged cards or any credit amounts on such cards.

Foyles reserves the right to add to or amend these terms and conditions.

Foyalty Terms & Conditions

To take part in the Foyles Loyalty Scheme (Foyalty), you need an activated Foyalty card. Cards are available from and can be activated in any of our participating stores and online.

Foyalty cards remain the property of W&G Foyle Limited and can only be used when making purchases in Foyles stores and outlets or online.

To earn Foyalty points you must present the card to the cashier at the time of purchase or during the online checkout procedure.

One point is allocated for each 25p spent on products within the scheme. Each point is worth 1p and can be redeemed at any time to purchase valid products. These rates can be altered at the discretion of Foyles on reasonable notice to you. Notification will be given by notices in participating stores and on the Foyalty web page.

Applicants must be aged 16 years or over.

Employees of W&G Foyle Limited are not eligible for a Foyalty card or for Foyalty points.

Your Foyalty card is purely to be used in connection with the Foyles Loyalty Scheme. It is not a credit, debit or cheque guarantee card.

Foyalty is only for consumer use. The Foyalty card cannot be used for any transaction where the beneficiary is a business entity. This also excludes use by Foyles Credit Account Customers.

Foyles reserves the right to alter products included or excluded from the Scheme or to change the number of participating stores at any time.

Foyles reserves the right to decline issue, withdraw the Foyalty card, or alter its terms & conditions (including the value of points) at any time, or terminate the Foyalty card Scheme without notice. Foyles will notify Cardholders (where possible) of any changes to these terms and conditions. Notices detailing the revised terms will be available in all participating Foyles shops and on the Foyalty web page.

Cardholders cannot claim points on purchases made before they joined the Foyalty Scheme.

Points will be awarded on all merchandise sold in participating Foyles stores and online excluding concessions, with the exception of eBooks, Foyles Gift cards, Book Tokens, Theatre Tokens, stamps, electronic devices and other products or services from time to time as notified.

Points will usually be loaded onto your card immediately. In the event of a system failure points will be applied as soon as is possible. Foyles takes no responsibility for circumstances beyond their control. Points cannot be redeemed until loaded on to the card.

The full points value on an item will only be earned if no points value is redeemed as part of the transaction. When points are redeemed as part of the transaction, points will be awarded on the cash balance.

Points have no cash redemption value and cannot be exchanged, sold or transferred.

Foyles may if it so wishes, reverse the associated points earned or redeemed if a transaction on which points are earned or redeemed is cancelled or reversed or when a product is returned (in accordance with Foyles Returns Policy). For instore purchases, the Cardholder must present their Card to sales staff so that the points awarded can be debited from or credited to the Card when the product is being returned.

If you breach these terms and conditions or if W&G Foyle Limited reasonably believes that you have abused the Scheme and/or breached these terms, your card may be terminated without prior notice. Foyles reserves the right to take any action deemed necessary where a Cardholder is found to have abused the scheme including withholding points previously credited to your account.

If your Card is lost, stolen or is not working please contact a member of staff at a Foyles store or call +44 (0) 20 7437 5660. Foyles cannot be held liable for lost, stolen or damaged Cards, or any points accrued on or redeemed from the card without your knowledge. Foyles reserves the right not to issue a replacement card.

Foyalty can be used in conjunction with other discounts or promotions, but Foyles reserves the right to withdraw this at any time or may alter the products included or excluded in a promotion.

If any clause of these terms and conditions is held to be invalid in whole or in part, that part shall be deleted and the validity of the remaining terms shall not be affected.

These terms and conditions and the Foyles Loyalty Scheme are subject to the laws of England and Wales.

These terms and conditions and Foyles Privacy Policy, govern Foyles use of personal data collected from Cardholders. Foyles will not pass your details on to any third party not involved in the running of this Scheme unless you have agreed that we may pass your details on to other companies.

By signing up to the Scheme and giving us personal details, you agree to be sent updates and special offers unless you subsequently notify us otherwise.

We will also use your details and information on what you buy to help us manage the Scheme more effectively.

It is important that your contact details are kept up to date in order that Foyles can operate the Scheme effectively. If your details are incorrect or become out of date, you can update them by visiting the Foyalty web page. You can also update your details (including your email address) at anytime by calling +44 (0) 20 7440 557. If you hear a voicemail message please leave your card number your issue & a contact telephone number and we will reply the same day.

Promotional codes and discounts

Foyles may occasionally provide customers with codes that can be entered during checkout or are built into external links that are used to obtain further discounts on our website. The following terms apply.

Discounts are only available on www.foyles.co.uk unless specifically stated to include other domains or stores as listed for the particular promotion.

As standard some items are excluded from all promotional discounts. This includes, but is not restricted to all Foyles Gift Cards National Book Tokens, Theatre Tokens, The Animator's Survival Kit DVDs, goods where the cost of purchase by Foyles is less than the final advertised online price, all Marketplace titles and all eBook titles. In most cases this is because the prices are set by third parties not Foyles.

Foyles can change the items available for or excluded from discounts at any time and without warning.

Some codes will have a list of available items and all other items will be excluded. Where possible we will try to make it clear which products are available but if there is any doubt please contact our Customer Services Team.

Discounts may be time limited. If a discount code is not used within the allotted time Foyles will not provide a replacement code. Discount codes can only be used at time of purchase and not retrospectively.

Discount codes cannot be used with any other voucher, coupon or offer. This includes our Click & Collect (Reservation) and Student Discounts.

Discount codes are exclusive of online postage and packaging and gift-wrapping charges.

Except for the Click & Collect discount, values are deducted from the Foyles Online Price. Where a code entitles the user to extra Foyalty points or other types of bonus offers the order value will not alter and the extra points or bonuses will be applied when the sale is completed and not before.

The Click & Collect discount is deducted from the List price.

ALL discounts are only completed at the point of sale not at order. As the cost of goods to Foyles is often unknown at the time of order Foyles reserves the right to withdraw an item from the discount code after this information becomes available if the discounted value is less than Foyles cost of purchase. Wherever possible Foyles will agree a fair price with the customer, but if this is not possible the order will be cancelled.

Where a product is substituted in an order placed with a promotional code the replacement product must fall within the original codes product range or other terms to qualify. If it does not the standard online price and terms will be applied.

An individual promotional code may have specific terms and conditions which apply to it. and will be provided to the user when the code is provided.

Customer Reviews and Ratings policy

To be able to post reviews you must have a website Login. You can create one here.

You can create a Nickname to appear as your name on reviews and blogs. With no Nickname chosen we will use your Login First Name & Last Name. As this is independent of any name used in your billing and delivery addresses you can use this as an alternative nickname facility if you wish.

Writing a review is a great way to share your experience of a book with thousands of other readers. You'll appreciate there need to be a few ground rules, some are obvious (no bad language) some are to save us from being sued and some are to ensure your review gets read again and again. Reviews that don't follow these rules will be removed and will not qualify for any promotional offers we may run associated to leaving reviews.

Reviews will be visible not only to users of the Foyles Website but the content may appear on search engines and other content aggregators.

Do

  • Make your review of the book NOT the service you have received from Foyles when buying it. Even though we love hearing nice things, it IS a book review!
  • Give an honest opinion
  • Tell others how the book made you feel
  • Point out what you disliked or liked
  • Let other readers know what books and authors would be of similar interest, eg 'Great for fans of Harry Potter'

Don't

  • Use profanity, prejudiced language or terms of abuse
  • Repeat or make potentially libellous comments
  • Mention web addresses, emails or phone numbers
  • Post text you've not written
  • Post material that is deliberately intended to upset other users
  • Give away key plot elements or endings

Ratings

We also require reviewers to rate the item at the same time as this gives an overview of the customer opinion. You can leave a Rating without a review but not a review without a rating. Leaving a rating alone does not qualify for any Review promotion that may be running.

Ratings guide:

- Excellent - I would recommend this without reservation.
- Really Good - I would strongly recommend this.
- Good - I would recommend this.
- Indeterminate - The Good and bad aspects combined mean this is not actively recommended.
- Bad - I would not recommend this.

Our Rate & review Emails

30 days after a purchase has been completed we will email you to see if you are interested in leaving a review. This email is included in correspondence about you order and is separate from our mailing list system. Any promotional codes provided for leaving reviews will expire within 23-30 days from the date of the email.

Events Terms and Conditions

Foyles believes that events are an important part of the bookshop experience, and we commit to supporting authors and publishers with a regular programme of events, launches and book signings on our premises.
Agreement to host an event, made in writing between Foyles and a third party organiser and stating a mutually-agreed time and date, is considered a binding contract, subject to the following terms and conditions.

  1. It is the author/publisher/organiser's responsibility to disclose in full to Foyles all details relevant to the event, and to make Foyles aware of any legal action taken, or threatened, against any author, publisher or publication related to the event, before an agreement to host the event is made. Failure to do so will be considered a breach of contract, and Foyles reserves the right to reschedule or cancel an event without prior notice until such a time as any associated legal situations have been resolved to its satisfaction.
  2. Foyles reserves the right to reschedule or cancel an event on any of its premises, or any external venues, at any time due to a lack of reservations or any other unforeseen circumstances, at its sole discretion. Reasonable notice will be given where possible except in the most extreme cases, e.g. acts of god, author illness etc.
  3. Foyles reserves the right to cancel an event with no prior notice should it believe that holding said event on its premises, or in an external venue, will adversely affect Foyles' reputation, or the health, safety and wellbeing of its employees and customers.
  4. Foyles will reimburse in full any tickets purchased via the Foyles website or in store, but will not be liable for any costs, losses or expenses, or other effects, such as any impact on professional or personal reputation, incurred on the part of the author, publisher and/or organiser, or for any potential loss of earnings as a result of the rescheduling or cancellation.
  5. Foyles reserves the right to remove from its premises before, during or after an event, any individual or group of individuals who we believe pose a threat to Foyles' reputation, or the health, safety and wellbeing of its employees or customers.
  6. Foyles reserves the right to record its events and to use the resulting audio, video, images and quotations for its own purposes.
  7. Most Foyles events are intended for adults, but children under the age of 14 are welcome at their parents' or guardians' discretion, and must be accompanied by an adult at all times. Foyles does not accept any responsibility for material unsuitable for a younger audience at such events.

eBook General Terms and Conditions of Foyles and txtr GmbH

Key points:

  • eBooks are not refundable after purchase.
  • A UK billing address is required.
  • Free Adobe Digital Editions software is needed to read your eBook and should be downloaded beforehand.
  • Some eBooks have prices set by the publisher which cannot be altered and neither Foyalty points nor Gift Cards can be used in payment and Foyalty points cannot be earned.

1 Applicability

The following General Terms of Use apply to all business relations between txtr GmbH ("txtr") and its customers ("Users") in the version applicable at the time of concluding the contract. Users' conditions which deviate from these Conditions will not be accepted by txtr unless explicitly agreed upon in writing.In the following, "Foyles, powered by txtr" will also be referenced as "txtr".

2 Specification of Services

1.txtr operates for business purposes the website http://ebooks.foyles.co.uk (the "Foyles powered by txtr Website"). On this Website, Users have access to the areas txtr Store (the "txtr Store") as well as txtr Platform (the "Platform").
2.On the txtr Store, the User has access to a catalogue with digital files of various forms, especially books, magazines and similar products. With the download of these products the User may obtain a license according to Section 4 et seq. of these Conditions or may download texts free of charge (the "eBooks"). On the Platform the User has, inter alia, the possibility to download texts free of charge and to upload and administer his or her own digital documents.
3.txtr offers any User the possibility to load the application (the "txtr App") being offered bytxtr for certain mobile phones and similar players like Tablet Cs (the "mobile players") free of charge on its mobile player. Depending on the txtr App Version the User has access to the area txtr Store.

3 Registration & Use

1.Prerequisite for the purchase of an eBook or for an upload of his or her own digital documents on the Platform, is the registration of the User by creating an account on the txtr Website or via the txtr App (the "Registration"). Further functions and services available on the Platform and via the txtr App, in particular access to the txtr Store, may be used without a Registration.
2.The Registration is free of charge. txtr is authorized to check or let other parties check the data given by the User for plausibility and to refuse or revoke a Registration. The User shall provide true, up-to-date and complete information when registering and placing orders, and inform txtr immediately about changes of the data given.
3.Upon the first Registration the User will receive a User ID and a password (the "Access Data"), which is necessary for future logins. The User shall organize his or her Access Data in a secure way, keep them confidential and notify txtr without delay if he or she loses the Access Data or suspects that third parties may have unauthorized knowledge of them. If through the negligence of a User, a third party uses the services of txtr on the basis of such Access Data, the User shall be personally liable for any damages incurred by txtr as a result. txtr shall not be liable for damages caused to the User due to abuse or loss of the User's Access Data.
4.On the occasion of the first Registration and with each future login after any changes of the Conditions, the User will be explicitly asked to accept these General Terms of Use as binding. If he or she rejects, the User cannot use those services, for which he or she needs a Registration.
5.txtr provides its service only to legal age users.

4 Contract conclusion via the txtr Store and Terms of Use

1.On the txtr Store, the User may obtain the right to use eBooks. The presentation of the range of products on the txtr Store represents a non-binding invitation to the User to order these products. The eBooks are classified by different categories. Each eBook indicates its title, author and/or publisher, as well as the price, including V.A.T, optionally further information is available. The price is due and payable immediately upon ordering. txtr accepts only those forms of payment offered to the User within the context of the respective order. Payments by direct debit and credit card will be charged on the day of invoicing.
2.In order to acquire an eBook, the User shall select an eBook and put it into his or her virtual cart. To continue the purchase, first-time Users must be registered and/or have to sign up upon later purchases. The payment method and the invoice address may be verified and saved as future base setting. When continuing the acquisition, the User views the details of his or her order, in particular the total purchase price. The User may then submit the order finally and bindingly. Should a bank debit not be carried out or be returned, the User authorizes the Bank to inform txtr of his or her name and present whereabouts.
3.The acceptance of the contract by txtr occurs with the immediate download of the eBook on the User's account or Mobile Device. The User obtains the download directly and does not have to activate it first. As soon as the download is made, the risk will pass to the User. The User waives any right to receive an additional declaration of acceptance according to Art. 151 S. 1 BGB.
4.After having purchased eBooks the User has no right of withdrawal or return, as the User cannot return an eBook because of the basic possibility of a continued use.
1.Should txtr for any reason not be able to supply the eBook the User will be informed about the unavailability. Payments already made will be reimbursed to the User without delay.
2.The User can read the eBooks offered by txtr only by using an Adobe ID. The Adobe ID can be created online at Adobe. Under the DRM (Digital Rights Management) licence the use of eBooks may be limited to a certain number of terminal devices.
3.When buying an eBook the User will acquire the use licence as defined under Art. 5 (the "E-Book Licence"). The eBook Licence will only be awarded on the condition that all claims against the User arising out of the order have been completely settled. The User is only entitled to set off counterclaims which are undisputed or have been established by a court of law.
1.The User acknowledges that returns of purchased eBooks can only be made for corrupt or defective eBooks.

5 Rights of use on eBooks and freely available files

1.The content of the downloads being distributed by txtr is protected by copyright. The User undertakes to agree and adhere to the copyrights. No copyrights, rights of use nor other property rights to the content will be transferred to the User unless otherwise stated in these General Terms and Condition, in the End-User-License Agreement and/or the conditions highlighted during the purchase of the eBook or in the product descriptions.
2.With the download the User acquires the simple, non-transferable right to use the offered eBook only for personal, domestic and non-commercial, non-institutional, non-corporate and non-teaching use. The download of the eBook does not provide any commercial or promotional use rights in such eBook. Before receiving full payment of the purchase price, txtr is entitled to revoke this right to use.
3.In particular the user is not allowed to change the content of the downloads or make editorial changes or to use modified versions, to copy the downloads for third parties, to make them publicly available or to forward them to third parties, to put them on the Internet or on other networks, to copy, resell or use them for commercial purposes.
4.In the case of the content publisher is being located in the United States of America ("US Publisher"), the User acknowledges that any claims against this publisher shall be interpreted and construed in accordance with the laws of the State of New York in the United States of America, without giving effect to their principles of conflicts of law and that by using the txtr Store the User waives any claims against the US Publisher that may arise under the laws of other countries or territories located outside of the United States or states other than New York. The state courts of the State of New York in and for New York County, and if the jurisdictional prerequisites exist, the United States District Court for the Southern District of New York, and no other court or tribunal, shall have sole and exclusive jurisdiction to hear and determine any dispute or controversy arising out of the US Publisher's eBooks or concerning the US Publisher. With respect to any such action or proceeding against a US Publisher, the User irrevocably (a) consents and submits to the personal jurisdiction of said courts, and (b) waives the defense of lack of personal jurisdiction and/or inconvenient forum and/or improper venue.

6 Services on the Platform

1.On the Platform, the User has the option to download freely accessible texts free of charge.
2.The User may compile his or her own files and make texts accessible for certain Users. The disk space for uploaded content is limited for each User. In case the user uploads own texts or texts of third parties, then the user will accept automatically and explicitly Art. 7 of these Terms of Use.

7 Lawfulness of Multimedia Content

1.txtr only provides the necessary disk space for and access to the content which is uploaded by the User. The User shall be solely responsible for the content uploaded by him or her to the txtr Platform. The User shall ensure that such content does not violate any applicable laws and statutory provisions, public policy and, in particular, the rights of a third party (naming, privacy, copyright, data protection, etc. rights). In particular, the User undertakes not to upload any content that violates provisions of the Criminal Code, the Interstate Treaty governing the Protection of Minors in the Media (JMStV) or laws governing firearms.
2.The User shall not transmit data or store data on a data carrier of txtr that, given their type or nature (e.g. viruses), size or reproduction (e.g. spamming), could jeopardize the functioning or operation of the services and data network of txtr. Furthermore, the use of computer programs for the automatic readout of data, such as crawler, is prohibited on the txtr Platform without the express consent of txtr. The User shall be liable to txtr for any damages resulting from the transmission of such prohibited data.
3.If the User is in breach of any of the aforementioned prohibitions and guidelines of these Terms of Use, txtr may reject the User"s content, delete and block content immediately and block the User from further uploads, delete the pages and any references thereto immediately and/or terminate the User's registration with immediate effect. In such event, the User is not entitled to the restoration of his or her content on the txtr Platform.

8 Availability and liability

1.According to the current state of the technology the data communication on the Internet cannot be guaranteed perfectly and any time availably. txtr does not provide any guarantee or warranty with respect to the availability of its services. txtr shall not accept any liability for defects that are beyond its control.
2.The User bears sole responsibility for the selection of the eBooks.
3.txtr may limit access to its services if such limitation is required for the safety and reliability of the net, the integrity of the network, in particular the prevention of serious disruptions of the network, the software or stored data.
4.txtr is liable for cases of intent and gross negligence. txtr is not liable for slight negligence insofar as no important contractual obligation (cardinal obligation) has been hurt, insofar as no warranty has been given for the state and condition of a product, insofar as no maliciously concealed defects or a case of default or impossibility occurred. In the event that important obligations have been hurt due to slight negligence, txt shall be liable only to the amount of the typically foreseeable damage. The previously mentioned liability exclusions shall not apply in case of injury to life, body or health. The liability according to the Law on Product Liability remains untouched.txtr shall not be liable for the display of content on the txtr Website or via the txtr App. txtr distances itself explicitly from the content of all pages to which direct or indirect reference (so-called "Links") is made from within the services and the Platform of txtr. txtr shall not be liable for such content and pages whatsoever. Only the providers of such pages shall be liable for the content of such pages.
5.The liability for consequential damages such as loss of profit, missing savings and other indirect damages as well as the compensation for expenses incurred in vain shall be excluded. If the liability of txtr is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.
6.txtr shall not be liable for data being stored on the txtr Website or on the Mobile Device. Each User shall be liable and is recommended to secure backups of his or her files.

9 Data protection

1.txtr undertakes to handle all personal User data in strict confidence according to statutory provisions and to collect, process and use the data during the term of the agreement only for the purposes of executing the agreement, unless User expressly consents to other uses. The data are collected, used and processed electronically. A separate Datenschutzerklärung (Data Privacy Statement), to explain the issues relating to data protection, has been attached hereto. The User shall hereby acknowledge such Privacy Statement.
2.The User consents explicitly to the collection, use and processing of his or her personal User data.
3.Upon registration the User expressly agrees that his or her address and email may be used for occasional information regarding the update and new services of txtr. The consent may be withdrawn by informal report at any time.

10 General Provisions

1.German Law shall apply for these General Terms of Use and all legal relations between the User and txtr. The provisions of the German Conflict of Laws and the International Sale of Goods shall not apply.
2.Jurisdiction over any disputes arising in connection with txtr shall lie with the courts in Berlin, Germany, as far as legally admissible.
3.Should individual provisions hereof shall be or become void or incomplete, the validity of the remaining provisions hereof shall in no way be affected. The contractual partners will replace the invalid provision by a legally effective provision which closest reflects the economic purpose of the invalid term. The above regulation shall also apply to possible loopholes.

Data Privacy Statement (Datenschutzerklärung)

1. Data collection

When registering at the txtr GmbH ("txtr") and when creating its own user profile, the User submits informations about its own personal or material circumstances such as email address, date of birth, sex and domicile ("Personal data"). These Personal data will be handled by txtr, respectively by the involved payment provider with regard to the method of payment, in strict confidence according to the legal provisions. During the term of the agreement the data will only be collected, processed and used for the purpose of executing the agreement, unless the User expressly consents to other uses.
The collection, use, and process of data is carried out electronically. In order to improve its product range continually, txtr collects anonymized data for the use of its Apps, for example which contents are accessed in the txtr Store or how the txtr Apps are used. The user may deactivate this data collection in the settings of the App. txtr never stores data about read books or reading habits without the explicite approval of the user. The data transfer between the App and the Server is SSL encrypted.

2. Data use

txtr will ony transfer personal data to third parties if this is legally required by law and/or if txtr has the express permission of the user.
txtr is entitled to transfer personal data to third parties, if those parties shall carry out services and actions by order and for txtr, for example to let the software run on the platform of remote servers or carry out and settle up payment processes for offered products or services. In this respect txtr complies with the provisions of Art. 11 BDSchG.
For the purposes of advertising, marketing, and structuring the services of txtr according to needs, txtr carries out research in regard of the interests and behaviour of the user. This is made by an anonymous procedure, so no personal data is transferred which allows direct conclusions on the user. The user has the right to stop the process and use of its data.
During the term of the agreement txtr may send the User a newsletter with information, for example relating to support, technical advice and other information regarding its services, if the User has agreed to receive this newsletter. The User may cancel the newsletter at any time and free of charge by using the link in the newsletter.
txtr shall be entitled to collect, process and use the User "s master and connection data for the purpose of identifying, delimiting and removing malfunctions and errors in the telecommunication systems. If the requirements are met, txtr may collect, process and use the master and connection data that are necessary to uncover any unlawful use of the telecommunication systems and services. In accordance with prevailing legal provisions, txtr may provide information to criminal prosecution authorities and courts for prosecution purposes. Upon request, txtr shall provide the User with the information on the stored data relating to the User's person or pseudonym, free of charge and without delay. The information can be provided electronically, if desired. Apart from this, txtr will pass on neither the User's data nor the content of the User's private messages to third parties without the User's explicit prior consent.

3. Cookies

txtr uses codes from text and numbers (the "Cookies") on the txtr Website which allow the use of the Website by the User, with which the User may be identified during its visit on the Website and be re-identified when visiting the Website again. These Cookies are stored on the Computer of the User.
txtr reserves the right to use Google Analytics. Google Analytics also uses Cookies. The information about the use of the Website created by the Cookie (inclusive the IP-address of the User) are transferred in such a case to a Server of Google and are stored there. Google will use this information in order to analyse the use of the Website, in order to issue reports about the activities of the Website for the Website operator and in order to provide further services being related with the use of the Website and the use of the Internet. Google may transfer these information to a third party, provided this is legally compulsory or as far as third parties process these data in the name of Google. Google will not associate the IP address of the User with any other data held by Google.
The user can deactivate such cookies in the settings of its computer. However, it might then be possible that the user cannot use all functions of this Website. By using this Website the user agrees that its anonymously collected data are used in the manner described above, but the user is also aware, that Cookies may possibly store the IP-address of the terminal used by the user .

4. Usage Tracking

In order to improve txtr's offer, txtr continuously collects data for the use of the App. Thereby txtr investigates for example which content the users view in the Shop or which functions of the App they use. This collected data is user-related, which means a so-called "App ID" is transferred, allowing txtr to allocate the usage data to the App being installed on your device. txtr collects the "App ID", in order to allocate the collected user behavior always to the same user. txtr only evaluates the data anonymously, i.e. user data is not connected with personal user accounts in order to offer users e.g. personalized offers. The transfer of the user data out of the App is made via an encrypted connection.
When the user logs in to the App with his personal user account it allows txtr, to collect this user data. The user may revoke their permission at any time via the settings in the App. This will effect all future usage unless the user re-activates the function.
No usage data is recorded in the App demo mode.

5. Data protection

txtr explicitely notifies the User, that data protection and data privacy during data transfer via open networks such as the Internet cannot be completely guaranteed under the current state of technology. The User understands and acknowledges that the provider can view, in technical terms, the pages stored on the web server and, perhaps, other User data stored on such server at any time. The User shall be fully responsible for ensuring that the data transmitted to the internet and stored on web servers are protected and secure.

6. Validity of the Data Protection Regulation

txtr shall be entitled to change this Data Privacy Statement by observing the applicable data protection provisions. Whenever this Privacy Statement is changed, txtr will notify this to the User on the occasion of his or her next login. The User has the possibility to object to any change within 14 days in writing, whereby an email shall be deemed to be sufficient. In such a case, txtr may terminate the provision of services to the User.
