Auf europaischer Ebene ist Haupt- und Vorzeigeinstitut des Klimaschutzes das 2005 neu eingefuhrte CO2-Zertifikatehandelssystem. Es ist eine Art Marktordnung, die auf der europaischen Emissionshandelsrichtlinie beruht, die jedoch eine Reihe wesentlicher Entscheidungen dezentral an die Mitgliedstaaten delegiert, allen voran die Allokation der Zertifikate. Diese Arbeit hat zum Ziel, die grundrechtlichen Vorgaben fur den nationalen Gesetzgeber bei der Entscheidung uber die Zu- und Aufteilung der Zertifikate zu analysieren. Hierzu nimmt sie auf Basis einer Untersuchung der naturwissenschaftlichen und okonomischen Grundlagen den nationalen ebenso wie den europaischen Rechtsrahmen in den Blick. Ziel ist nicht, die Verfassungsmassigkeit bestehender Regelungen zu diskutieren, sondern allgemeingultige Grundsatze zu entwickeln und so unter Einbeziehung aktueller Entwicklungen einen Handlungsspielraum des Gesetzgebers zu definieren."
