A SHORT, YET DETAILED, EXPLANATION OF THE COMPLEX MANAGEMENT OF CATASTROPHIC INJURY CLAIMS An appreciation by Phillip Taylor MBE and Elizabeth Taylor of Richmond Green Chambers A splendid group of contributors have been assembled for this publication to produce an excellent short guide on the complex subject of the management of catastrophic injury claims in association with the Association of Personal Injury Lawyers (APIL). Graham Aldous QC, Peter Andrews QC, Stuart McKechnie and Terry Lee examine the detailed and continuing care and rehabilitation regimes covered in 18 chapters and in just over 400 pages. The authors review the sophisticated case management requirements covering technical procedure matters with the significant use of expert evidence as well as the complicated settlements and financial structures including periodical payments orders. In the Foreword, the then APIL President, Muiris Lyons. describes the guide as invaluable for anyone handling catastrophic injury claims, being both welcome and overdue. It is particularly useful for APIL to be associated with this publication from Jordans because the nature of catastrophic injury claims involve acting for the most severely injury individuals and their families. Lyons describes this authoritative guide as a roadmap for the successful pursuit of these difficult claims capturing, as it does, a wealth of knowledge and experiences as it goes on its way. There are 3 aspects which Lyons, in his own words, highlights about the book: • It provides a unique insight into what is actually required from the PI lawyer when dealing with the client and the family. And at the heart if it is the bond of trust required for the claim to be successfully pursued; • Recognition for the guide’s medical content which go to the fundamental parts of the claim; and • Material relevant to clinical negligence claims as well as personal injury claims. This edition covers the following areas as there were in 2010: the Civil Procedure Rules; the Rehabilitation Code; the development of Court Case Management functions, particularly in clinical negligence cases; changes in the funding of claims, including CFAs; the Mental Capacity Act 2005 and changes in the Court of Protection; Alternative Dispute Resolution methods including Mediation; and the Damages Act, Periodical Payment Orders and the challenges facing Claimants in damages management. We have found this guide an excellent exposition of how to approach catastrophic injury claims but there has been so much recent change that readers must be aware that the title is rapidly becoming a bit dated so we look forward to a new edition to update the main subject areas.
