Synopsis

This comprehensive and practical book will enable you to accurately and confidently identify the type of enforcement proceedings appropriate to your client's needs. As well as helping practitioners to choose the most appropriate means of enforcement, the book highlights the problem of whether seeking the transfer of proceedings to another court will enable practitioners to take advantage of a means of enforcement not available in the original court. Enforcing Financial Orders in Family Proceedings is divided into four parts. Part I introductory, provides guidance on how to anticipate and avoid enforcement problems at all stages of the proceedings and considers the important issues of limitation, interest, death and bankruptcy from the standpoint of enforcement. Part II addresses the subject from the perspective of the order to be enforced, with a specific chapter dedicated to each type of order and suggests the appropriate means of enforcement in each case. Part III deals in a practical manner with the law and procedure relating to each method of enforcement and the reasons for choosing one method over another.

Part IV covers aids to enforcement: injunctions, oral examination and the book also contains a summary of the armed forces' internal enforcement procedure.
