Synopsis

Das Buch behandelt in zahlreichen Fallen das Spannungsverhaltnis zwischen Vertragsfreiheit, Inhaltskontrolle, Verbraucher- und Diskriminierungsschutz ("AGG"). Den Schwerpunkt bildet allerdings die klassische Rechtsgeschaftslehre. Das Buch wendet sich nicht nur an Studienanfanger, sondern mochte auch vor dem Staatsexamen bei einem zweiten Durchgang durch den Allgemeinen Teil nutzliche Dienste leisten. Zur Erleichterung der Stoffwiederholung dienen umfangreiche "Merke"-Satze, die die examensrelevanten Probleme des Allgemeinen Teils widerspiegeln. Die Falllosungen sind im Interesse einer das erforderliche Prufungswissen vermittelnden und vertiefenden Darstellung ausfuhrlicher gehalten, als dies von einer Examensklausur erwartet werden kann. Gerade bei Klausuren, die u.a. Fragen der Anfechtung von Willenserklarungen zum Inhalt haben, treten im Staatsexamen immer wieder erhebliche Fehler auf. Die Verfasser mochten deshalb insbesondere ein vertieftes Verstandnis des Rechts der Irrtumsanfechtung wecken.
