Synopsis

Seit 2006 ist die neue Bauordnung von Berlin in Kraft, die weitgehend die Regelungen der Musterbauordnung 2002 aufgreift.



Die aktuelle Berliner Bauordnung beruht auf den grundsatzlichen Erwagungen, sich im Verfahrens- wie im materiellen Recht auf die aus heutiger Sicht notwendigen Regelungen zu beschranken.

- Reduzierung der Prufprogramme der Baugenehmigungsverfahren,



- Deregulierung und Vereinfachung des materiellen Bauordnungsrechts.



Die 6. Auflage des bewahrten Kommentars liefert aktuelle Erlauterungen, in die Praxiserfahrungen der letzten zwei Jahre Eingang fanden.



Ausfuhrlich behandelt werden unter anderem das Abstandsflachenrecht, der Brandschutz, die am Bau Beteiligten, die bauaufsichtlichen Verfahren, die Behandlung des Bauantrages, die Prufung bautechnischer Nachweise und die Regelungen uber Bauprodukte und Bauarten.

Thomas Meyer ist Architekt und leitet als Senatsrat in der Senatsbauverwaltung fur Stadtentwicklung und Wohnen langjahrig die Oberste Bauaufsicht. Dr. Justus Achelis ist langjahriger Justitiar des Deutschen Instituts fur Bautechnik (DIBt). Annegret von Alven-Doering war langjahrige Vorsitzende einer Baurechtskammer des Verwaltungsgerichts Berlin. Dr. Mathias Hellriegel LL.M. ist Rechtsanwalt und Fachanwalt fur Verwaltungsrecht und Grunder der Sozietat HELLRIEGEL RECHTSANWAELTE in Berlin. Matthias Kohl ist Richter am Oberverwaltungsgericht Berlin-Brandenburg und dort Mitglied des u.a. fur Baurecht zustandigen 2. Senats. Markus Rau LL.M. ist Richter am Verwaltungsgericht Berlin und war dort langjahriges Mitglied einer Baurechtskammer.
